01_ACCEPTANCE_OF_TERMS
By accessing the VG Automotive website (https://vgautoworks.com), requesting services, or engaging with VG Automotive in any capacity, you (“Client,” “User,” or “You”) agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and VG Automotive, a mobile automotive repair service operating in California.
If you do not agree to these Terms, you must immediately discontinue use of our website and refrain from requesting our services.
02_SERVICE_DESCRIPTION
VG Automotive provides mobile automotive repair, diagnostic, and maintenance services (“Services”) primarily in the following service areas:
– Primary Sector: Morongo Basin, including Yucca Valley, Joshua Tree, 29 Palms, Landers, and Morongo Valley
– Active Zone: Coachella Valley, including Palm Springs, Cathedral City, and Palm Desert
– Extended Range: Los Angeles, Orange County, and Greater Southern California for specialized services
Services include but are not limited to: diagnostic services, engine repair, electrical system repair, brake services, cooling system repair, routine maintenance, and specialized work on vintage vehicles, particularly Japanese automotive engineering from the 1980s-1990s era, including Datsun Z-Cars and Nissan 300ZX vehicles.
03_SERVICE_APPOINTMENTS_AND_SCHEDULING
3.1 Appointment Booking
Services are provided by appointment. Appointments may be requested via:

3.2 Emergency Services
Emergency roadside services are subject to technician availability. VG Automotive will make reasonable efforts to respond to emergency requests but does not guarantee immediate availability for all emergency calls.
3.3 Cancellations
Clients must provide at least 24 hours’ notice for appointment cancellations. Cancellations made with less than 24 hours’ notice or no-show appointments may be subject to a cancellation fee equal to the diagnostic fee or a minimum service charge.
3.4 Service Area
While VG Automotive primarily operates in the designated service areas, we reserve the right to decline service requests outside our normal operating range or to charge additional travel fees for extended-range service calls.
04_FEES_AND_PAYMENT
4.1 Pricing
Service pricing is based on diagnostic fees, labor rates, parts costs, and travel charges (where applicable). All prices quoted are estimates unless otherwise specified in writing. Final charges may vary based on actual work performed and parts required.
4.2 Diagnostic Fees
A diagnostic fee may be charged for evaluation and diagnosis of vehicle issues. This fee covers the technician’s time and expertise in identifying problems and may be applied toward repair costs if repairs are authorized and completed.
4.3 Payment Terms
Payment is due upon completion of services unless alternative arrangements have been made in writing. Accepted payment methods include cash, check, and major credit cards (subject to availability).
4.4 Parts Markup
Parts supplied by VG Automotive include a reasonable markup to cover procurement, handling, and warranty administration costs.
4.5 Late Payment
Invoices not paid within 30 days of the invoice date may be subject to a late fee of 1.5% per month (18% annual percentage rate) or the maximum rate permitted by California law, whichever is lower.
05_CLIENT_RESPONSIBILITIES
5.1 Accurate Information
Clients must provide accurate and complete information regarding vehicle symptoms, history, and prior repairs to enable proper diagnosis and repair.
5.2 Vehicle Access
For mobile services, clients must provide safe, accessible workspace and adequate lighting for the technician to perform services. Clients must ensure the service location is free from hazards.
5.3 Authorization
Clients must have legal authority to authorize repairs on the vehicle presented for service. VG Automotive is not responsible for disputes arising from unauthorized repair requests.
5.4 Vehicle Condition
Clients represent that the vehicle is in safe operating condition for diagnostic and repair services. Clients must disclose any known safety hazards, including but not limited to: fluid leaks, structural damage, or modified safety systems.
06_WARRANTIES_AND_GUARANTEES
6.1 Workmanship Warranty
VG Automotive warrants that all services will be performed in a workmanlike manner consistent with industry standards. Warranty periods vary by service type and will be communicated at time of service.
6.2 Parts Warranty
Parts supplied by VG Automotive carry the manufacturer’s warranty. VG Automotive will assist in warranty claims but is not responsible for manufacturer warranty denials.
6.3 Client-Supplied Parts
VG Automotive offers no warranty on client-supplied parts. Labor warranty may be reduced or voided for repairs using client-supplied parts.
6.4 Warranty Exclusions
Warranties do not cover:
– Normal wear and tear
– Damage from accidents, abuse, or neglect
– Modifications made after service
– Failure to follow recommended maintenance
– Issues unrelated to the services performed
– Vintage or classic vehicles beyond normal service parameters (specialty terms apply)
6.5 Disclaimer
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, VG AUTOMOTIVE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow limitations on implied warranties, so this limitation may not apply to you.
07_LIMITATION_OF_LIABILITY
7.1 Service Limitations
VG Automotive’s liability is limited to the cost of the specific service performed. We are not liable for:
– Consequential damages, including lost wages, towing costs, rental vehicle costs, or other indirect costs
– Pre-existing conditions not discovered during diagnosis
– Damage from causes beyond our control
– Problems arising after the vehicle has been returned to the client
7.2 Maximum Liability
In no event shall VG Automotive’s total liability exceed the amount paid by the client for the specific service giving rise to the claim.
7.3 Vintage and Modified Vehicles
Repair of vintage, classic, modified, or specialty vehicles involves inherent risks due to age, parts availability, and non-standard configurations. Clients acknowledge these additional risks when requesting services on such vehicles.
08_INTELLECTUAL_PROPERTY
All content on the VG Automotive website, including text, graphics, logos, images, and software, is the property of VG Automotive and protected by United States and international copyright laws. Unauthorized use, reproduction, or distribution of website content is prohibited.
The VG Automotive name, logo, and all related marks are trademarks of VG Automotive. Use of these marks without express written permission is prohibited.
09_PRIVACY_AND_DATA_COLLECTION
VG Automotive’s collection and use of personal information is governed by our Privacy Policy, available at https://vgautoworks.com/privacy-policy. By using our services, you consent to our privacy practices as described in the Privacy Policy.
VG Automotive collects vehicle diagnostic data, repair history, and client contact information to provide services. This information may be retained for warranty purposes, service history, and business operations.
10_DISPUTE_RESOLUTION
10.1 Informal Resolution
In the event of any dispute, clients agree to first contact VG Automotive directly to seek informal resolution.
10.2 Mediation
If informal resolution is unsuccessful, disputes shall be submitted to mediation in San Bernardino County, California, before pursuing legal action.
10.3 Arbitration
Any disputes not resolved through mediation shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in San Bernardino County, California.
10.4 Class Action Waiver
Clients agree to bring claims only in their individual capacity and not as part of any class or representative action.
10.5 Small Claims Court
Either party may bring an individual action in small claims court as an alternative to arbitration.
11_INDEMNIFICATION
Client agrees to indemnify, defend, and hold harmless VG Automotive, its owner, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:
– Client’s breach of these Terms
– Client’s use of services
– Client’s violation of any law or rights of third parties
– Inaccurate information provided by Client
– Client’s unauthorized modification of vehicle after service
12_VEHICLE_STORAGE_AND_ABANDONMENT
If a vehicle is left at a service location or in VG Automotive’s custody for more than 30 days after completion of repairs without payment or client communication, it may be considered abandoned. VG Automotive reserves the right to charge storage fees and may pursue a mechanic’s lien in accordance with California law.
Storage fees, if applicable, will be communicated to the client in writing.
13_SAFETY_AND_COMPLIANCE
13.1 Regulatory Compliance
All services are performed in accordance with applicable California and federal regulations, including but not limited to emissions standards, safety regulations, and environmental laws.
13.2 Recall Information
VG Automotive may reference the NHTSA recall database during diagnostic services. However, clients remain responsible for checking recall status and obtaining manufacturer recall remedies.
13.3 Safety Disclaimer
While VG Automotive performs services to high professional standards, clients acknowledge that mechanical repairs cannot guarantee future performance or safety. Regular maintenance and inspections are the client’s ongoing responsibility.
14_MODIFICATIONS_TO_TERMS
VG Automotive reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Continued use of services after changes constitutes acceptance of modified Terms. Material changes will be communicated via email to clients with accounts or posted prominently on the website.
The “Last Updated” date at the top of this document reflects the most recent revision.
15_SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
16_ENTIRE_AGREEMENT
These Terms, together with the Privacy Policy and any written service agreements, constitute the entire agreement between client and VG Automotive regarding services and supersede all prior agreements, representations, and understandings.
17_GOVERNING_LAW
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action must be brought in the appropriate court in San Bernardino County, California.
